Supreme Decree No. 005-2026-MIDAGRI Approving the Regulations of Law No. 31920 to Promote Potato Industrialization

Supreme Decree No. 005-2026-MIDAGRI, published on June 17, 2026, approves the Regulations of Law No. 31920, which promotes the industrialization of potato production in Peru. The regulations comprise seven titles, seventeen articles and three final supplementary provisions and establish measures to strengthen competitiveness, sustainability and value addition throughout the potato value chain. Their nationwide scope covers public and private individuals and legal entities engaged in potato production, processing, marketing and promotion. The regulations encourage primary processing and the production of potato-based goods, including flour, chips, instant mashed potatoes and starches, as well as linkages with domestic markets and agricultural export chains. They provide for pilot projects and co-financing mechanisms for machinery acquisition and technical capacity building, associative contracts between producers and enterprises, agricultural extension and technical assistance, research and technology transfer, seed certification and the promotion of improved varieties. They also provide for guarantee funds and special credit lines for seed producers, together with financing programs for small and medium-sized producers and agroindustrial infrastructure projects. The regulations assign responsibilities to the Ministry of Agrarian Development and Irrigation (MIDAGRI), the National Institute of Agrarian Innovation (INIA), the National Agricultural Health Service (SENASA), the Development Finance Corporation (COFIDE), and regional and local governments. Implementation is coordinated with the National Agroindustrial Competitiveness Plan and the regulations of Law No. 31339. The decree aims to increase producer profitability, improve the quality of processed potato products, strengthen industrial linkages and facilitate market access. Implementation is financed through the budgets of the institutions concerned without additional resources from the Public Treasury. The stated outcomes are expected regulatory objectives rather than empirically verified impacts.
