United States–Peru Trade Promotion Agreement (Peru–United States Free Trade Agreement)

The United States–Peru Trade Promotion Agreement (PTPA), signed in Washington, D.C., on April 12, 2006, and in force since February 1, 2009, establishes a bilateral legal framework to liberalize and facilitate trade in goods and services, promote investment, and strengthen economic relations between the two countries. In Peru, the agreement was approved through Legislative Resolution No. 28766, ratified through Supreme Decree No. 030-2006-RE, and implemented through Supreme Decree No. 009-2009-MINCETUR. The agreement contains provisions on national treatment and market access for goods, progressive tariff elimination, rules of origin, customs administration and trade facilitation, sanitary and phytosanitary measures, technical barriers to trade, trade remedies, government procurement, investment, cross-border trade in services, financial services, telecommunications, electronic commerce, intellectual property, competition, labor, environment, transparency, and dispute settlement. For agrifood systems, it establishes preferential conditions for bilateral trade in agricultural and food products and rules concerning market access, origin, customs procedures, and compliance with sanitary and technical requirements. The agreement also incorporates environmental commitments and specific provisions related to forest-sector governance. Implementation is undertaken by the competent authorities of Peru and the United States through the institutional mechanisms established by the agreement. The PTPA remains a bilateral international treaty in force and should not be confused with Peru's domestic instruments approving, ratifying, and implementing the agreement or with subsequent complementary instruments. Its expected outcomes include improved market access, greater predictability in trade relations, facilitation of bilateral trade, and common rules supporting safe and transparent trade.
