Comparing the former EUTR and upcoming EUDR: Some implications for private sector and authorities

The EU adopted the Deforestation-Free Supply Chains Regulation (EUDR) to reduce its impact on global deforestation. This regulation prohibits certain forest-risk commodities and their derived products from entering the EU market unless they are deforestation-free and legal under the legislation of the producing countries. The EUDR replaces the European Timber Regulation (EUTR), broadening its approach to closing legal loopholes. The EUDR introduces mandatory digital registration and control options for customs authorities, increases accountability obligations within the EU, and reduces Member States’ discretion in national legislation and enforcement. Although the EUDR closes some loopholes in the EUTR, it also imposes higher reporting burdens and significantly expands its scope. It remains to be seen how it will affect procurement costs and product prices in the EU, and whether it could shift trade towards countries with fewer regulations.
