Legislative Decree No. 107 of 2025 on the Protection of Agricultural Areas, Production Chains and Agrifood Systems during the State of Internal Disturbance in Catatumbo

Colombia's Legislative Decree No. 107 of January 29, 2025 established extraordinary measures to protect, restore and stabilize agricultural activities, farming and livestock areas, irrigation systems, production and supply chains, agrifood systems and food supplies in territories affected by the State of Internal Disturbance declared under Decree No. 062 of 2025. Its territorial scope covered the Catatumbo region, municipalities in the metropolitan area of Cúcuta, and the municipalities of Río de Oro and González in the department of Cesar. The decree primarily targeted peasants, small and medium-sized agricultural producers, their organizations and communities affected by forced displacement and public-order disturbances. It authorized the Rural Development Agency to directly procure goods, services and logistics to implement agricultural support measures and incentives aimed at maintaining production, protecting crops and livestock and ensuring access to irrigation systems and water resources. It required agricultural promotion funds operating in the affected territories to allocate at least 2 percent of the parafiscal contributions included in their 2025 annual budgets to legally authorized purposes supporting local production chains. It also instructed AGROSAVIA and the Colombian Agricultural Institute to protect, conserve, distribute and reintroduce seeds and propagation material, alongside technology and knowledge transfer measures. The decree sought to restore rural livelihoods, preserve food supply chains and protect the human right to food. Through Judgment C-249 of June 11, 2025, Colombia's Constitutional Court declared Legislative Decree No. 107 of 2025 unconstitutional. Accordingly, the framework is recorded as terminated, and its provisions are described as historically adopted measures rather than currently applicable instruments.
