Colombia's Legislative Decree No. 0174 of 2026: Relocation of Agricultural Production Units and Recovery of Rural Assets Affected by the Climate Emergency

Colombia's Legislative Decree No. 0174 of February 24, 2026 establishes extraordinary measures to enable the temporary or permanent relocation of agricultural production units and rural assets affected by the economic, social and ecological emergency declared under Decree No. 150 of 2026 in the departments of Córdoba, Antioquia, La Guajira, Sucre, Bolívar, Cesar, Magdalena and Chocó. The decree declares the acquisition of land and rural productive assets required for emergency response to be a matter of public utility and social interest, with the aim of restoring agrifood systems and agricultural productive capacity. It authorizes the National Land Agency to implement exceptional procedures for temporary occupation, easements, acquisition, expropriation, registration and allocation of rural land, subject to applicable legal safeguards. It also provides for land compensation and restitution measures, replacement productive projects for affected beneficiaries, drainage and flood-control works, ecosystem-service restoration, and expedited administrative and procurement procedures. The decree prioritizes affected farming families, small producers, rural communities and ethnic peoples, seeking to restore livelihoods, strengthen food security and promote climate-smart social and productive land reorganization.
