Description
Law No. 32437, the Modernized Irrigation Law, establishes the regulatory framework for promoting public and public-private investments in on-farm modernized irrigation systems in Peru. Its objective is to improve water-use efficiency, modernize irrigation infrastructure and expand agricultural land under irrigation, including rainfed areas, existing irrigated land, land suitable for grazing and uncultivated land with agricultural potential. The law establishes responsibilities for national, regional and local governments, irrigation water user organizations and other entities involved in planning, promoting and implementing irrigation investments. It also provides for incentives and multiple financing sources, including public resources, private contributions, donations and international cooperation. The law requires the Ministry of Agrarian Development and Irrigation to provide technical support to regional and local governments, establishes transitional provisions for investment projects and repeals Law No. 28585, which created the Modernized Irrigation Program. Published on September 11, 2025, it entered into force on March 5, 2026, following publication of its implementing regulation under Supreme Decree No. 002-2026-MIDAGRI.
