Law No. 28585: Establishment of Peru's Technified Irrigation Program (2005-2026)

Law No. 28585, establishing the Technified Irrigation Program, provided Peru with a legal framework to promote the progressive replacement of traditional agricultural irrigation systems with technified irrigation systems. It declared the establishment of the program to be a matter of public necessity and utility and assigned regional and local governments responsibilities for planning and promoting its implementation within their jurisdictions, in coordination with the competent national authorities. Its purpose was to encourage the modernization of agricultural irrigation and support more efficient water use. The law provided the legal foundation for the program, while operational procedures, intervention mechanisms and specific implementation requirements were developed through subsequent regulations, particularly Supreme Decree No. 004-2006-AG. Its relevance to agrifood systems is direct because it addresses agricultural production and irrigation water management. Law No. 28585 was expressly repealed by Law No. 32437, the Technified Irrigation Law, published on September 11, 2025, whose entry into force was conditional upon publication of its implementing regulations. These regulations were approved by Supreme Decree No. 002-2026-MIDAGRI, published on March 5, 2026. Accordingly, this framework is classified as concluded following the entry into force of the new legal regime. The law does not, by itself, provide evidence of completed irrigation works, disbursed investments or verified productivity improvements.
