Decree Law No. 22175: Law on Native Communities and Agricultural Development in the Selva and Ceja de Selva Regions

Decree Law No. 22175 establishes the legal regime governing Native Communities and provisions for agricultural development in Peru's Selva and Ceja de Selva regions. The law recognizes the legal existence and legal personality of Native Communities and regulates their organization, registration and territorial rights. It establishes procedures for the demarcation of communal territories and the granting of property titles over land suitable for agricultural and livestock activities, as well as the legal treatment applicable to forest-suitable land located within communal territories. It also contains provisions concerning land use, agricultural and forest activities and the organization of production within its territorial scope. For PAESA purposes, its directly relevant mechanisms are the legal recognition of Native Communities, land delimitation and territorial organization, and the recognition and formalization of rights over communal territories. These mechanisms are directly linked to land tenure security, territorial planning and the use of agricultural and forest resources. Although the law contains broader provisions concerning economic and agricultural development in the Selva and Ceja de Selva regions, it should not automatically be classified under every contemporary rural development, financing, technical assistance, environmental conservation or commercial promotion instrument.
