Supreme Decree No. 001-2023-MIDAGRI: Amendment to the Agricultural Food Safety Regulation for Family Farming and Public Food Procurement

Supreme Decree No. 001-2023-MIDAGRI, published on February 9, 2023 and effective from August 10, 2023, amends the Agricultural Food Safety Regulation approved by Supreme Decree No. 004-2011-AG. The decree introduces specific sanitary provisions to facilitate the participation of family farmers and family farming producer organizations in public food procurement procedures governed by Law No. 31071. It requires family farming producers identified in the Register of Agricultural Producers and Their Organizations in Value Chains to comply with Good Production and Primary Processing Practices for Family Farming to ensure the safety of the primary agricultural food products they supply. It establishes differentiated sanitary authorization requirements for these producers, who must obtain a Certificate of Good Production and Primary Processing Practices for Family Farming issued by the National Agricultural Health Service (SENASA). The decree also amends documentation requirements for sanitary authorization of establishments and requires social program administrators and donation-receiving entities to verify the relevant certification of family farming suppliers participating in public food procurement. It includes transitional provisions for identifying producers pending implementation of the agricultural producer register, introduces definitions of good practices and clarifies the coverage of unprocessed non-timber forest food products intended for human consumption. The decree modifies sanitary and regulatory conditions applicable to primary production and processing and to family farming participation in public food procurement. It does not create a new public procurement program, establish subsidies or financing, or demonstrate actual increases in productivity or farm incomes.
