Law No. 31310: Amendment to the Family Farming Promotion and Development Law to Advance Digitalization

Law No. 31310, published on July 24, 2021, amends Law No. 30355, the Family Farming Promotion and Development Law, by introducing provisions concerning digitalization, continuity of sectoral planning and the classification of family farming in Peru. Through an amendment to Article 8, it assigns the Ministry of Agrarian Development and Irrigation (MIDAGRI) responsibility for promoting the digitalization of family farming, with particular emphasis on subsistence family farming, through technologies intended to improve agricultural profitability and production. It also introduces Article 11, extending the validity and effects of the National Family Farming Plan 2019-2021 until approval of the Multisectoral Strategic Plan intended to implement the National Family Farming Policy. The law further requires the establishment of family farming categories based on socioeconomic, technological, environmental, productive, social, cultural and territorial characteristics, with quantitative definitions to be developed through implementing regulations. Finally, it instructs MIDAGRI to amend the regulations implementing Law No. 30355 and the relevant internal sectoral rules within ninety days following publication. The law constitutes a regulatory amendment intended to strengthen the family farming policy framework; it does not directly establish subsidies, credit facilities, digital infrastructure investments or a standalone technical assistance program. Improvements in profitability and production are stated policy objectives rather than empirically demonstrated outcomes.
