Guidelines for Granting Land Use Assignment Contracts for Agroforestry Systems (Executive Directorate Resolution No. 081-2017-SERFOR/DE)

Executive Directorate Resolution No. 081-2017-SERFOR/DE, published on March 30, 2017, approved the Guidelines for Granting Land Use Assignment Contracts for Agroforestry Systems. The guidelines establish standardized technical criteria and administrative procedures for granting contractual land use rights over publicly owned land intended for agroforestry systems. Their purpose is to promote the formalization of agricultural, forestry and livestock activities conducted in agroforestry production, silvopastoral and recovery zones, in accordance with Law No. 29763, the Forestry and Wildlife Law, and its implementing regulations. The guidelines govern the identification of eligible areas, the submission and assessment of applications, ex officio procedures, verification of requirements, prevention of overlapping land rights and execution of contracts by the competent regional forestry and wildlife authority. Contracts may cover areas of up to one hundred hectares and are granted for renewable forty-year periods under the applicable legal framework. The guidelines also address the registration of assigned areas and their incorporation into the National Forest Cadastre. The instrument seeks to provide legal certainty regarding land use rights and facilitate the formalization of agroforestry activities without transferring land ownership. It does not establish a land titling program, agricultural subsidies, credit facilities or specific restoration or emissions reduction targets.
