Regulation on Environmental Infractions and Sanctions in the Agricultural Sector (Supreme Decree No. 017-2012-AG)

Supreme Decree No. 017-2012-AG, published on November 14, 2012, approved the Regulation on Environmental Infractions and Sanctions in the Agricultural Sector and its Schedule of Environmental Infractions and Fines. It established the administrative sanctioning procedure applicable to breaches of environmental obligations contained in legislation, environmental management instruments, management plans and concessions falling within the environmental responsibilities of the agricultural sector. The regulation governed environmental supervision, inspection and enforcement by the competent agricultural environmental authority, the classification of infractions, criteria for determining fines, administrative measures and procedures for establishing liability. Its purpose was to prevent and sanction environmental noncompliance arising from agricultural activities and strengthen enforcement of sectoral environmental legislation. The regulation entered into force after 120 calendar days counted from the first working day following its publication, while certain categories of infractions became applicable progressively. Supreme Decree No. 006-2024-MIDAGRI subsequently repealed the general regulatory framework effective June 10, 2024, except for Article 49 and item 1.2.1 of section 1.2 of the Schedule of Environmental Infractions and Fines, whose repeal was deferred until the entry into force of the new classification of infractions and scale of sanctions approved by the Environmental Assessment and Enforcement Agency (OEFA). Accordingly, the regulation is classified as substantially terminated as of June 2024, subject to the transitional validity of the expressly retained provisions.
