Peru: Supreme Decree regulating the procedure for the formalization of water use (D.S Nº 001-2024-MIDAGRI)

Description

Supreme Decree No. 001-2024-MIDAGRI establishes the procedure to regularize the use of water through the issuance of licenses, aimed at those persons who, until December 31, 2014, have used the water resource and continue to do so in a public, peaceful and continuous manner. This procedure applies to natural and legal persons throughout the national territory, including those who use seawater or desalinated water, regardless of the type of use they give it. The National Water Authority (ANA), through the Local Water Administration (ALA), is the entity in charge of conducting and resolving the formalization process, the mentioned procedure comprises two main stages: (i) the presentation of the request following the established format, and (ii) the evaluation and resolution by the ALA within a maximum period of 30 working days, counted from the date of presentation. If no response is issued within this period, the negative administrative silence will be applied.
