Framework Law on the National Environmental Management System (Law No. 28245)

Law No. 28245, published on June 8, 2004, establishing the legal framework for Peru's National Environmental Management System (SNGA). Its purpose is to ensure the effective achievement of public institutions' environmental objectives and strengthen cross-sectoral coordination of environmental responsibilities at national, regional and local levels, preventing overlapping mandates, omissions, duplication and institutional conflicts. The system integrates public institutions with environmental responsibilities and regional and local environmental management systems, with participation by the private sector and civil society. The law regulates environmental management principles, planning and management instruments, institutional coordination, environmental authorities' responsibilities, regional and municipal environmental commissions, public participation and access to environmental information. It also provides for coordination of environmental impact assessment, environmental quality standards, maximum permissible limits, environmental planning and the National Environmental Information System. Its central purpose is to strengthen environmental governance and ensure coherent public action to protect the environment and promote sustainable use of natural resources. The law remains in force, and its current implementing regulation was approved by Supreme Decree No. 014-2024-MINAM, which repealed the previous regulation approved by Supreme Decree No. 008-2005-PCM. Original institutional references to the National Environmental Council should be understood in light of the subsequent establishment of the Ministry of the Environment and changes to Peru's environmental institutional framework.
