Peru: Law No. 31335 for the improvement of the associativity of agricultural producers in agricultural cooperatives.

This Law establishes the legal framework to strengthen, promote and support users' agricultural cooperatives and their integration entities, granting them a tax regime in accordance with their nature. It defines the requirements for their constitution, their governance, and creates the National Council of Agricultural Cooperatives (CONACA), the highest level body in this area, under the direction of MIDAGRI. MIDAGRI assumes key functions in the promotion, technical assistance, supervision and management of the information system for agricultural cooperatives. The National Registry of Agricultural Cooperatives is also created. The regulation grants benefits similar to those of MSEs and an additional 10% in public contracting. Processes for the transformation of associations into cooperatives are regulated and benefits are provided for irrigation projects. A specific tax regime is established, with provisions on income tax and VAT exemptions, in addition to the tax responsibilities of cooperatives. Finally, two funds are created: one for research and development, and the other for agricultural guarantees and insurance, administered by the MEF.
