Environmental Management Regulation for the Agricultural and Irrigation Sector (Supreme Decree No. 006-2024-MIDAGRI)

Regulation approved by Supreme Decree No. 006-2024-MIDAGRI, published on June 9, 2024, establishing the regulatory framework for environmental management of investment projects and activities in Peru's agricultural and irrigation sector. Its provisions are mandatory for public and private individuals and legal entities carrying out activities within the sector's jurisdiction, including primary agricultural and livestock production and processing, irrigation, water-resource development infrastructure, and primary forestry production or processing. The regulation governs environmental assessment and certification, project operators' obligations, environmental management instruments, and procedures for bringing ongoing activities into environmental compliance. It covers environmental studies under the National Environmental Impact Assessment System and complementary environmental management instruments, including Environmental Technical Forms, environmental adjustment instruments, closure plans, and supporting technical reports, as applicable. It establishes mechanisms for preventing, mitigating and managing environmental impacts, together with monitoring and enforcement provisions. The Ministry of Agricultural Development and Irrigation, through its General Directorate of Agricultural Environmental Affairs, exercises the corresponding sectoral environmental responsibilities. The regulation was amended by Supreme Decree No. 005-2025-MIDAGRI, while Annex II was amended by Ministerial Resolution No. 0058-2026-MIDAGRI. Its principal purpose is to ensure environmental sustainability in agricultural and irrigation activities through regulatory instruments and environmental management procedures.
