General Agricultural Health Law (Legislative Decree No. 1059)

Peru's General Agricultural Health Law, approved by Legislative Decree No. 1059, published on June 28, 2008, and effective from June 29, 2008. It establishes the national legal framework for preventing, controlling and eradicating plant pests and animal diseases, protecting agricultural and livestock production, and promoting sanitary conditions that facilitate access to international markets for agricultural products. The law designates the National Agricultural Health Service (SENASA) as the competent national authority and regulates sanitary and phytosanitary measures, surveillance, control campaigns, inspections, quarantine, movement of regulated products, export certification and controls on products entering the country. It also establishes provisions for the registration, control and enforcement of agricultural pesticides, veterinary products, biological pest-control agents and other agricultural inputs, together with administrative infringements and sanctions. The law has been amended by several provisions, including Law No. 30190 and Legislative Decrees No. 1387 and No. 1701. It applies nationwide and provides a legal framework directly related to plant and animal health and safe trade in agricultural products.
