Law on Access to Genetic Heritage, Protection of Associated Traditional Knowledge and Benefit Sharing for Biodiversity

Description

Legal framework that regulates access to Brazilian genetic heritage, protection and access to associated traditional knowledge, and fair and equitable sharing of benefits derived from its economic exploitation. It establishes management, control and oversight systems through a Genetic Heritage Management Council, procedures for prior informed consent from traditional communities and mechanisms for monetary and non-monetary benefit sharing. It provides administrative sanctions for infractions, creates the National Fund for Benefit Sharing and the National Benefit Sharing Program for the conservation and sustainable use of biodiversity. It includes provisions for the regularization of activities carried out before its entry into force.
