Peru: Supreme Decree No. 004-2011-AG – Agricultural and Food Safety Regulation

Supreme Decree No. 004-2011-AG, published on April 27, 2011, approves Peru's Agricultural and Food Safety Regulation, which aims to ensure the safety of primary agricultural food products and animal feed, protect human life and health, safeguard consumer rights and promote the competitiveness of national agriculture. The regulation implements Legislative Decree No. 1062, the Food Safety Law, and establishes the operation of the National Agricultural and Food Safety System (SINIA), led by the National Agricultural Health Service (SENASA), with the participation of regional and local governments. It regulates good production and hygiene practices, hazard analysis and critical control point principles (HACCP), sanitation procedures, maximum permissible contaminant limits, traceability, and the transportation and storage of primary agricultural food products and animal feed. It also establishes mechanisms for sanitary surveillance, inspection, contaminant monitoring, sanitary authorization of establishments, management of food safety alerts and protective measures, including immobilization, product withdrawal, suspension of activities, seizure and final disposal. The regulation provides for control and certification procedures, operator responsibilities and coordination among competent authorities. It applies nationwide to individuals and legal entities involved in the production, primary processing, transportation, distribution and marketing of primary agricultural food products and animal feed. The regulation was subsequently amended, among other provisions, by Supreme Decrees No. 006-2016-MINAGRI and No. 001-2023-MIDAGRI.
