Supreme Decree No. 3318 aims to regulate Law No. 906, which regulates the revaluation, production, circulation, transportation, marketing, consumption, research, industrialization and promotion of coca in its natural state as a renewable natural resource. This decree establishes detailed regulations for each of these activities and assigns specific responsibilities to different government entities. The decree defines authorized areas for coca production in the departments of La Paz and Cochabamba, specifying surface limits and registration requirements. In addition, it introduces the mandatory nature of a producer card, which is valid for five years and is issued by associations and government entities, depending on the region. Marketing activities are also regulated, including obtaining a marketing card, rules for the transportation and packaging of coca leaf, and the creation of authorized markets in La Paz and Cochabamba. Likewise, the maximum quantities allowed for retail marketing and the deadlines for said activity are detailed. The decree also establishes infractions and sanctions for various violations of the regulations, categorizing the infractions as minor, serious and very serious, and detailing the corresponding sanctions, which may include fines, confiscation and temporary or permanent suspensions of the right to market or industrialize coca. For the industrialization of coca, companies must register and comply with strict regulations, including obtaining authorizations and the obligation to report and allow inspections. The decree promotes research and industrialization of coca, coordinating efforts with universities and specialized institutions.
