Law No. 31361 of 2021 — Priority Access to Direct Island Guano Sales for Family Farmers

Law No. 31361, published on November 26, 2021, establishes priority for the direct commercialization of island guano to family farmers in Peru, with the objective of supporting the sustained growth and productivity of family farming. The law amends Article 4(c) of Law No. 26857, which established the Special Project for Promoting the Use of Fertilizers Derived from Seabird Deposits, requiring that island guano commercialization and distribution, in coordination with the competent agricultural authorities, prioritize family farmers nationwide. It defines direct commercialization as a purchase-and-sale transaction between the special project, subsequently absorbed by the Rural Agricultural Productive Development Program (AGRO RURAL), and a family farmer. The law also requires AGRO RURAL to adapt its internal regulations within thirty days. The measure establishes priority access to the island guano marketing channel and does not itself create a subsidy, free-distribution scheme or credit mechanism.
