Supreme Decree No. 007-2022-MIDAGRI on Financial Reintegration of Small-Scale Producers through the AGROPERÚ Fund

Supreme Decree No. 007-2022-MIDAGRI, published on June 2, 2022, adds a Fifth Supplementary Transitional Provision to Supreme Decree No. 004-2020-MINAGRI, which governs the restructuring of the AGROPERÚ Fund. The decree establishes a temporary, one-time exception, applicable until December 31, 2022, to certain eligibility requirements for financing small-scale agricultural and forestry producers. The measure covers AGROPERÚ Fund users and Agricultural Bank (Agrobanco) clients who have normalized the full outstanding balance of overdue loans through rescheduling, refinancing, judicial settlement or out-of-court settlement, provided they are not in default when submitting a new financing application. The exception applies to loans originally granted by December 31, 2021. The AGROPERÚ Fund Board may approve adjustments to direct financing programs and establish special financial reintegration programs, while Agrobanco participates in their implementation. The measure seeks to facilitate small-scale producers' return to formal financing and support the continuity of their productive activities. It is related to the restructuring of the AGROPERÚ Fund and the agricultural emergency measures adopted in 2022. It does not establish general debt forgiveness or guarantee automatic approval of new loans. The exceptional eligibility measure expired on December 31, 2022.
